U.S. Person Confirmation
Certain funds are offered to the public on the basis that they are not available to 'U.S. Persons' or 'U.S. residents', for reasons related to United States securities laws and regulations. The fund managers for certain funds will not accept orders to purchase fund shares unless they are satisfied that investors have given appropriate confirmations thay they are not U.S. Persons prior to investing.
We therefore need to obtain a 'non-U.S. Person' confirmation from clients in order to meet the requirements of these fund managers.
Definition
U.S. Person has the meaning set out in Regulation S of the United States Securities Act 1933 (as amended) (the 'Act') and includes any resident of the United States and / or a partnership or corporation organised under the laws of the United States or deemed to be so organised (where 'United States' means the United States of America, its territories and possessions, all areas subject to its jurisdiction or any political sub-division thereof, any state of the United States of America and the District of Columbia).
